Cetoex News – Amid several high-profile submissions, the US Securities and Exchange Commission (SEC) says recent spot Bitcoin ETF filings are inadequate. The statements arrive after asset management juggernauts BlackRock and Fidelity recently filed to launch their own spot Bitcoin exchange-traded funds. 

The Wall Street Journal reported that the SEC informed Nasdaq and Cboe of their perspectives on recent filings. Specifically, the report noted the agency’s statements that the filings weren’t “clear and comprehensive.” 

SEC Speaks on Recent Spot Bitcoin ETF Filings

Over the last few weeks, the digital asset industry has been surprised by a host of spot Bitcoin ETF applications that have arrived. Moreover, these applications have come from two of the largest names in traditional finance. Both BlackRock and Fidelity are some of the largest asset management firms on the planet and are seeking entry into the sector.

Yet, a recent report suggests that these entities may not be guaranteed approval. Indeed, The Wall Street Journal reported that the SEC has said recent spot Bitcoin ETF filings are inadequate, citing people with information on the ongoing procedures. 

Both Nasdaq and Cboe Global Markets filed the ETF applications on behalf of the asset managers. Consequently, people have noted the SEC’s response as pointing to their inadequacy. Specifically, stating that “the filings are sufficiently clear and comprehensive,” according to sources.

The recent developments have not been limited to the two firms, as a host of Bitcoin ETF applications have arrived. Companies like Ark Investment Management, Invesco, WisdomTree, and others have gotten in on the competition.

The move would mark a massive moment for the digital asset industry. The implementation of an ETF that tracks Bitcoin’s price would only create a larger opportunity for investors to enter the sector. Yet, it appears as though the SEC is continuing its penchant to reject similar applications. 

Since 2017, the SEC has repeatedly rejected similar applications. Typically, the regulator points to the potential for market manipulation and fraud in their reasoning. Moreover, the news likely contradicts recent analysis stating that BlackRock could have a 50% chance of approval.

Cetoex News – The US Securities and Exchange Commission (SEC) has opted to delay the required payment of a $30 million fine levied against BlockFi until all investors are repaid. Moreover, a court filing from Thursday shows that the regulator has forfeited its spot as one of the first creditors to be paid by the crypto platform. 

The move comes after the regulator filed charges against some of the largest cryptocurrency exchanges in the industry. However, its enforcement-first approach to regulation has been heavily criticized. Subsequently, the immense pressure on the agency may have led to this move.

SEC Opts to Forgoe BlockFi Fine For Now

The SEC has undoubtedly been under a microscope in recent weeks. Filing charges against well-known cryptocurrency exchanges Coinbase and Binance, its regulatory approach has been the subject of much debate. Now, it has made a rather surprising decision in a previous legal situation regarding a different crypto platform. 

Specifically, the SEC has decided to delay the $30 million BlockFi fine until the platform’s investors are repaid. Indeed, the decision follows a $100 million settlement between the regulator and the crypto platform. Moreover, the platform had failed to register with the agency, leading to the enforcement.

Thereafter, BlockFi filed for Chapter 11 bankruptcy protection, a situation that stemmed from the collapse of FTX. When it became insolvent, it held $1 billion to $10 billion in customer assets. Thus, it did not have the necessary capital to repay the $30 million SEC settlement,

The agency had been noted as among the first creditors. Meaning, the SEC would be paid first after the restructuring process was completed. Conversely, the filing today has seen that change. Specifically, the SEC noted that the settlement be changed to “general unsecured claims” within the bankruptcy action.

The decision will allow investors to see their money repaid before the SEC receives its fine payment. Additionally, the crypto lender has developed a strategy to pay customers back. Hopefully, that process can be implemented as soon as possible.

Cetoex News – The US Securities and Exchange Commission (SEC) is launching an investigation into First Republic Bank executives over allegations of insider trading. Moreover, Bloomberg reported that the investigation is observing the conduct of executives prior to the bank’s seizure and subsequent sale to JP Morgan Chase & Co. 

The SEC is specifically investigating whether members of its executive team improperly traded using inside information. Additionally, two people familiar with the matter disclosed the existence of the investigation and its content. 

SEC Probe First Republic Insider Trading Claims

The fall of First Republic Bank was one of many bank failures that have been observed this year. Moreover, the determination followed a similar fate for both Silicon Valley Bank and Signature Bank. Conversely, the SEC seems to be launching an investigation into First Republic Bank executives over claims of insider trading. 

Specifically, the US regulator is conducting a probe regarding the validity of trades made by executives using insider information. However, there is no signal as to which executive members are the subject of the probe that was revealed today.

Representatives for both JP Morgan, and the SEC have refused to comment at this point. Alternatively, First Republic was sold to the bank following its seizure by the US government on Monday. Subsequently, the sale arrived after a period of tremendous losses that faced the financial institution over the last week. 

Similarly, the SEC is conducting similar investigations into trading activity that took place at Silicon Valley Bank. Moreover, that investigation is regarding the collapse that took place in March.
